The new federal system has changed federal and state awards as they apply to incorporated employers as follows:
Pre-reform Awards
Incorporated employers who were bound by a federal award prior to the introduction of WorkChoices will continue to be bound by that award. These awards are now ‘Pre-reform Awards’.
Notional Agreement Preserving State Awards (NAPSA)
State awards which bound incorporated employers are now ‘Notional Agreements Preserving State Awards’ (NAPSA). A NAPSA is a transitional federal agreement that will continue to apply to the workplace for three years, or until replaced by a new federal award or workplace agreement.
