In late 2009, a decision was made by the Queensland Government to refer its industrial relations powers to the Commonwealth. This took effect on 1 January 2010. The practical impact of this decision is that the national workplace relations system, commonly referred to as 'Fair Work', now applies to all private sector employers and employees.
The award/s that applied in unincorporated workplaces prior to 1 January 2010 will not change as a result of the federal system now applying. This is due to a transmission period of one year (which commenced on 1 January 2010) providing for the recognition of state awards and Agreements, such as Certified Agreements, in the federal jurisdiction. Award Types
For those members who were referring to a Queensland Industrial Relations Commission ("QIRC") award, these such awards became known as Division 2B State Awards on 1 January 2010. Members who referred to a transitional federal award due to them being a member of the AHA, those transitional awards are now known as Division 2B State Reference Transitional Awards, and these awards will continue to apply until terminated by Fair Work Australia (which will be prior to the end of 2010).
Divison 2B State Awards will continue to apply for 2010, and from 1 January 2011, the relevant federal modern award will begin to apply, however this will be subject to transitional arrangements that have not yet been finalised.
