Unincorporated employers have been largely unaffected by the introduction of WorkChoices. Unincorporated employers who were operating under federal awards at 27 March 2006 (now ‘Transitional Awards’) will continue to be covered by those conditions until 27 March 2011.
After that time, unincorporated employers must decide whether to incorporate and continue using a federal award or revert back to a state award. Unincorporated employers using state awards continue to be covered by the state system.
